Restaurant Payroll: Taking the Tip Credit
By Stefan Schumacher, Editor of The Payroll Blog
We’ve seen recently that restaurant payrolls are on the rise, according to the U.S. Department of Labor’s job reports. If you work with or for a restaurant business, it’s important to understand some of the payroll requirements involved.
The Federal Labor Standards Act (FLSA) allows employers to pay $2.13 per hour when tipped employees receive at least $30 in tips during a month. This is how restaurateurs avoid paying the typical minimum wage of $7.25, however their employees’ regular rate of pay needs to add up to that amount. If the state has a higher minimum cash wage than the federal, the state law overrides the federal.
It’s important to note that laws may vary from state-to-state.
